By accessing and using the services provided by Your Sweet Therapist ("we," "our," or "us"), you ("client," "user," or "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

These terms constitute a legally binding agreement between you and Your Sweet Therapist, operating under the laws of India. If you do not agree with any part of these terms, please do not use our services.

  • ✓ By booking a session, you automatically accept these terms
  • ✓ We reserve the right to update these terms with notice
  • ✓ Continued use after updates constitutes acceptance

3. User Responsibilities

As a client using our services, you agree to the following responsibilities:

Session Attendance

  • • Attend scheduled sessions on time
  • • Provide 24-hour notice for cancellations
  • • Maintain a suitable environment for online sessions
  • • Ensure stable internet connection for video calls

Platform Usage

  • • Use the platform respectfully and appropriately
  • • Maintain confidentiality of login credentials
  • • Not share access with unauthorized persons
  • • Report technical issues promptly

Payment Obligations

  • • Pay fees as agreed upon booking
  • • Provide accurate billing information
  • • Notify us of payment issues promptly
  • • Understand refund and cancellation policies

Prohibited Activities: You may not use our services for illegal activities, to harm others, or to violate professional therapeutic boundaries. Violation may result in immediate termination of services.

4. Appointments & Scheduling

4.1 Booking Process

Appointments can be booked through our website, mobile app, or by contacting us directly. All bookings are subject to therapist availability and confirmation.

4.2 Session Types

4.3 Session Guidelines

  • Punctuality: Please join sessions on time. Late arrivals may result in shortened sessions.
  • Technology: Ensure your device has a stable internet connection and updated browser.
  • Environment: Choose a private, quiet space for confidential discussions.
  • Recording: Sessions may not be recorded without explicit consent from both parties.

5. Payment Terms

5.1 Fees and Charges

All fees are clearly displayed at the time of booking and must be paid in advance unless otherwise agreed. We accept the following payment methods:

  • • Credit and debit cards (Visa, Mastercard, RuPay)
  • • Digital wallets (Paytm, PhonePe, Google Pay)
  • • UPI transfers and net banking
  • • Bank transfers for package bookings

Billing Information

  • • All prices are in Indian Rupees (INR)
  • • GST is included in displayed prices
  • • Invoices are generated automatically
  • • Payment confirmations sent via email

5.2 Package Deals

We offer discounted packages for multiple sessions:

  • 3-Session Package: 5% discount with 1-month validity
  • 6-Session Package: 10% discount with 2-month validity
  • 12-Session Package: 15% discount with 4-month validity

Note: Package sessions must be used within the validity period. Unused sessions will expire and cannot be refunded or extended without prior arrangement.

6. Cancellation & Refund Policy

6.1 Client Cancellations

24+ Hours Notice

Full refund or free rescheduling. No cancellation charges apply.

12-24 Hours Notice

50% refund or reschedule with 25% fee. Subject to therapist availability.

Less than 12 Hours

No refund. May reschedule with 50% fee if therapist available.

No-Show

Full session fee charged. No refund or rescheduling available.

6.2 Emergency Situations

We understand that emergencies happen. In cases of:

  • Medical emergencies (with documentation)
  • Natural disasters or external circumstances
  • Technical failures on our end

We will work with you to reschedule without penalty or provide appropriate refunds.

6.3 Therapist Cancellations

If we need to cancel your session, you will receive:

  • Full refund or free rescheduling
  • Priority booking for next available slot
  • 24-hour advance notice when possible

7. Confidentiality & Professional Standards

7.1 Therapeutic Confidentiality

We maintain strict confidentiality in accordance with professional therapeutic standards and Indian privacy laws. Your sessions and personal information are protected under:

7.2 Exceptions to Confidentiality

Confidentiality may be breached only in the following circumstances as required by law:

  1. Imminent Risk of Harm: If you pose a serious risk to yourself or others
  2. Child Protection: Cases involving abuse or neglect of minors
  3. Court Orders: When legally compelled by court order
  4. Professional Consultation: Anonymous consultation with colleagues for treatment purposes

Our digital platforms employ:

8. Intellectual Property Rights

8.1 Our Content

All content on our website, app, and materials provided during therapy sessions, including but not limited to:

  • Therapeutic worksheets and exercises
  • Educational materials and resources
  • Website content, design, and functionality
  • Proprietary therapeutic methodologies

8.2 Client Usage Rights

You are granted a limited, non-exclusive license to:

  • Use provided materials for personal therapeutic purposes
  • Access and use our digital platforms during your engagement
  • Download resources specifically provided for your treatment

8.3 Restrictions

You may not: Reproduce, distribute, modify, or create derivative works from our content without written permission. This includes sharing therapeutic materials with others or using content for commercial purposes.

9. Limitation of Liability

9.1 Service Limitations

While we strive to provide the highest quality therapeutic services, please understand:

Treatment Outcomes

We cannot guarantee specific therapeutic outcomes. Mental health treatment success varies based on individual circumstances, commitment, and various external factors.

Technical Issues

We are not liable for technical failures, internet connectivity issues, or platform disruptions beyond our control that may affect session quality.

Emergency Situations

Our services are not emergency mental health care. In crisis situations, contact emergency services immediately. We are not liable for delays in emergency response.

Third-Party Actions

We are not responsible for actions taken by third parties based on our therapeutic recommendations or for client decisions made outside of sessions.

9.2 Liability Cap

Our total liability for any claims arising from our services shall not exceed the total amount paid by you for services in the 12 months preceding the claim.

Professional Standards: We maintain professional liability insurance and adhere to ethical guidelines set by relevant professional bodies in India.

10. Termination of Services

10.1 Client-Initiated Termination

You may terminate our therapeutic relationship at any time by:

  • Providing written notice via email
  • Discussing termination during a session
  • Requesting account closure through our platform

10.2 Therapist-Initiated Termination

We may terminate services in the following circumstances:

  1. Non-payment: Repeated failure to pay for services
  2. Inappropriate Behavior: Violations of professional boundaries
  3. Non-compliance: Consistent failure to engage in the therapeutic process
  4. Outside Scope: When your needs exceed our expertise
  5. Dual Relationships: When conflicts of interest arise

10.3 Termination Process

When termination occurs:

  • We will provide appropriate referrals when possible
  • Unused package sessions may be refunded (terms apply)
  • Client records will be maintained as per legal requirements
  • Final session may focus on termination and transition planning

11. Governing Law & Dispute Resolution

11.1 Applicable Law

These Terms of Service are governed by the laws of India, including but not limited to:

  • The Indian Contract Act, 1872
  • Information Technology Act, 2000
  • Consumer Protection Act, 2019
  • Mental Healthcare Act, 2017

11.2 Jurisdiction

Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

11.3 Dispute Resolution Process

Step 1: Direct Communication

Contact us directly to resolve concerns. Most issues can be resolved through open communication.

Step 2: Mediation

If direct resolution fails, we agree to attempt mediation through a mutually agreed mediator.

Step 3: Legal Proceedings

As a last resort, disputes will be resolved through the appropriate legal channels in Bangalore.

Consumer Rights (Consumer Protection Act, 2019)

As a consumer, you have rights under the Consumer Protection Act, 2019. For consumer disputes, you may approach the appropriate Consumer Disputes Redressal Forum. You can file complaints through the National Consumer Helpline: 1800-11-4000 or online at consumerhelpline.gov.in.
